Terms of Service
Terms and conditions for using the OperPilot platform available at app.operpilot.com.
1. Service Provider and Contact
The service provider and operator of the OperPilot platform is Warsaw Trade Spółka z Ograniczoną Odpowiedzialnością, ul. Eugeniusza Kwiatkowskiego 6/12, 03-984 Warsaw, Poland, KRS 0000583526, EU VAT ID: PL1132897602, REGON 362907969 (hereinafter: "Service Provider").

2. Definitions
- Application – the OperPilot platform and its user dashboard.
- User – any individual, sole proprietor, or corporate representative using the Application.
- Account – the User's individual workspace and credentials in the Application.
- Brand – a dedicated workspace organizing content, settings, and materials for a specific project.
- Profile – a linked page or profile on a supported external social media network.
- Content – text, imagery, graphics, videos, captions, and scheduling data managed in the Application.
- Integration – voluntary connection between the Application and third-party platforms (Facebook, Instagram, Google, YouTube, etc.).
- Token – secure OAuth access credential granted by an Integration provider upon User authorization.
- Plan – tier of Application features, whether free trial or paid subscription.
3. Scope and Nature of Services
OperPilot provides digital tools for creating, scheduling, and publishing social media content, leveraging AI-assisted suggestions, multi-brand workflows, and cross-platform scheduling.
OperPilot is a supportive productivity tool. It does not guarantee specific engagement metrics, follower growth, revenue figures, or uninterrupted third-party platform availability.
4. Technical Requirements
Using the Application requires an Internet connection, an up-to-date web browser supporting TLS encryption, an active email address, and enabled essential cookies.
Publishing content requires eligible third-party social media accounts and granted administrative permissions.
5. Registration, Authentication, and Account Security
Accounts may be created via email/password or supported external identity providers (e.g., Google SSO). The service agreement is concluded upon account creation and acceptance of these Terms.
Users must provide accurate information, safeguard authentication credentials, and immediately report any unauthorized access or security breaches.
6. Brands, Profiles, and Integrations
The User decides which external accounts to integrate. OAuth authorization is conducted directly via third-party providers.
Tokens are used strictly to perform User-directed actions (fetching profiles, scheduling, and publishing). The User may disconnect integrations at any time.
7. Content Scheduling and Publishing
Scheduled publications are triggered automatically according to the User's set calendar. External network disruptions or expired tokens may delay or prevent delivery, and the User remains responsible for final verification.
8. Artificial Intelligence Features
AI suggestions serve as creative drafts and inspiration. They do not constitute professional, legal, or financial advice. The User must review all AI-generated content before publication.
9. Intellectual Property and Content Rights
The User retains full ownership and intellectual property rights in their Content. The User grants the Service Provider a limited, non-exclusive license strictly necessary to store, process, and transmit Content to destination networks on the User's behalf.
10. Prohibited Activities
Unlawful use, spamming, harassment, intellectual property infringement, distributing malicious software, or attempting to compromise the security or integrity of the platform is strictly prohibited.
11. Plans, Pricing, and Payments
Pricing, currency (EUR or PLN), billing cycles, and subscription options are presented clearly before purchase. Payments are securely processed by Stripe.
No Pro-Rata Refunds for Prepaid Subscriptions: Fees for subscription packages paid in advance (in particular annual plans) are fixed-term lumpsum payments and are non-refundable on a pro-rata basis in the event of early cancellation, account downgrading, or account deletion by the User before the end of the prepaid period. In such cases, access to the Service remains active until the end of the paid billing cycle.
12. Service Availability and Maintenance
The Service Provider applies reasonable professional care to maintain high uptime, but uninterrupted availability cannot be guaranteed due to scheduled maintenance, external network failures, or force majeure.
13. Limitation of Liability
To the maximum extent permitted by applicable law, the Service Provider is not liable for indirect damages, lost profits, or business interruptions resulting from third-party social network outages or API changes.
14. Complaints Procedure
Complaints may be submitted via email to kontakt@operpilot.com and will be reviewed within 14 calendar days.
15. Consumer Rights & Statutory Withdrawal
Consumers residing in the European Union are entitled to statutory rights of withdrawal within 14 days under distance selling regulations, subject to statutory exceptions.
In accordance with applicable consumer law (including Art. 38(13) of the Polish Consumer Rights Act and EU Directive 2011/83/EU), the right of withdrawal does not apply to contracts for digital content or digital services where performance has begun with the consumer's prior express consent and acknowledgment that they thereby lose their right of withdrawal. Providing such consent during checkout results in immediate service provisioning and the waiver of the 14-day statutory withdrawal period.
16. Account Termination
Users may terminate their account at any time through application settings or by contacting support.
17. Governing Law and Amendments
These Terms are governed by Polish and EU law. Any disputes shall be submitted to the competent court in Warsaw, Poland.
